Republicans advance Barrett’s Supreme Court nomination despite Democratic boycott

No Democrats? No problem! The Senate Judiciary Committee voted on Thursday, October 22, to advance President Donald Trump’s nomination of Judge Amy Coney Barrett to the Supreme Courtwith confirmation as Democrats boycotted the session in protest, The New York Times reported,

Indeed, majority Republicans skirted the panel’s official rules to recommend her in the absence of their Democratic colleagues. Judiciary Committee rules that require members of the minority party to be present to conduct official business.

Democrats—livid over the extraordinarily speedy process during the current election—spurned the committee vote altogether and forced Republicans to break their own rules to muscle through the nomination. Without the votes to block the judge in either the committee or the full Senate, though, their action was “purely symbolic,” the Times said.

The lopsided 12-to-0 outcome set up a vote by the full Senate to confirm Judge Barrett on Monday, a month to the day after Trump nominated her to fill the seat vacated by the death of Justice Ruth Bader Ginsburg. If all goes according to plan, the president and his party would win a coveted achievement just eight days before the election.

That would fulfill the president’s hopes of stacking a conservative SCOTUS, should he need the judicial body to confirm his victory following the November 3 presidential election.

Gloating over the illicit move, Senator Lindsey Graham, Republican of South Carolina and the chairman of the committee, said just before the vote.“This is why we all run,” “It’s moments like this that make everything you go through matter.”

According to the Times, Judge Barrett, a 48-year-old appeals court judge who has styled herself in the mold of the man she calls her mentor, former Justice Antonin Scalia, promises to shift the court meaningfully to the right, entrenching a 6-to-3 conservative majority.

The Times predicts, “Her presence will likely shape American society for decades to come, with potentially sweeping implications for corporate power and the environment, abortion rights and gay rights, and a wide range of other policy issues including health care access, gun safety and religious freedom.”

Democrats have sharply opposed Judge Barrett on policy grounds. But their goal on Thursday was to tarnish the legitimacy of her confirmation, arguing that Republicans had no right to fill the seat vacated just over a month ago by the death of Justice Ginsburg, when millions of Americans were already voting.

They were particularly angry that Republicans had reversed themselves since 2016, when they refused to consider President Barack Obama’s Supreme Court nominee, citing the election nine months later.

“Democrats will not lend a single ounce of legitimacy to this sham vote in the Judiciary Committee,” Senator Chuck Schumer, Democrat of New York and the minority leader, said at a news conference on the steps of the Capitol, where he raised his voice to be heard over the cries of protesters opposed to the nomination.

“We are voting with our feet. We are standing together. And we are standing against this mad rush to jam through a Supreme Court nomination just days, days before an election,” Mr. Schumer said.

Inside the hearing room where the vote unfolded, Democrats’ empty chairs held large posters of Americans whose health care coverage they argued could evaporate if Mr. Trump’s nominee were to side with a conservative majority on the Supreme Court to strike down the Affordable Care Act when it hears a Republican challenge to the law next month.

“I regret that we could not do it the normal way,” Graham said, “but what I don’t regret is reporting her out of committee.”

Equinox to go up against Peleton and Mirror for streaming fitness supremacy

Earlier this month, Stephen Ross, the billionaire owner of the popular fitness brands, Equinox, SoulCycle, Precision Run, and Blink Fitness, sparked outrage and calls for a boycott of his businesses when he hosted a fundraiser for President Donald Trump in the fashionable Hamptons area of Long Island, New York.

But that hasn’t slowed down his push into the fitness category. In fact, Ross now has announced his intentions to take on Peloton, the New York City-based exercise equipment and media company that has revolutionized the home biking experience—connecting users to live and on-demand streaming on-screen classes across a variety of devices for $39 per month.

According to a report by Fast Company, Ross’s new digital venture will include two separate pieces of hardware and personalized content representing Ross’s portfolio of brands.

Slated for launch this fall, the platform will pair with a new stationary bike identical to the one found in SoulCycle studios—with the addition of an attached screen. Equinox also will sell its proprietary Woodway treadmill, which can already be found at its Precision Run studios.

The new digital venture (which has not yet been named, Fast Company says) will include all the brands’ signature workouts—led by top instructors—in one network. It is not meant to replace the live studio experience, rather to serve as an addition for dedicated members who want an at-home offering.

The new digital venture puts Equinox in direct competition with Peloton, which also boasts both treadmill and stationary bikes along with a broad range of fitness content. Last year, Peloton opened a new production studio dedicated to yoga and meditation in New York City. The streaming giant is now valued at more than $4 billion.

Peloton stands out in the $14 billion home fitness equipment market, but it’s becoming an increasingly crowded space: Fast Company notes the long list of competitive startups—among them,  Mirror (personal training, yoga), Crew (rowing), and Tonal (weight lifting) ; all of which are attempting to do what Peloton did for the indoor bike.

While approximately 16% of the U.S. population holds a gym membership card, a recent survey found that 54% of Americans who work out at least once a month are interested in buying an at-home fitness system.

Over the last few years, Equinox members increasingly have demanded more ways to interact with the brand on their own schedule. Around 86% of them would like to spend more time with the brand than they get to, according to a recent survey of SoulCycle riders.

The new platform will integrate live and recorded original video and audio content–and will start with an invitation-only launch in the fall, with the at-home equipment available for purchase by the winter. A more public rollout is set for early 2020.

Brands that backed away from NRA have seen big increases in word-of-mouth

Despite a significant increase in the number of people talking about the brands that have cut their ties with the National Rifle Association (NRA) following the February 14 mass shooting at Stoneman Douglas High School in Parkland, Florida, overall, consumer perceptions of those brands has remain unchanged, according to the findings of a YouGov BrandIndex released on March 1.

However, although brand perceptions remained the same, during the past week, the 17 brands that backed away from the NRA—among them, Delta, and Hertz, Enterprise, Avis and National Car Rental—have seen big increases in word-of-mouth.

Delta moved up from its previous word-of-mouth score of 9.3 to a current score of 15.3, according to YouGov. Hertz followed (1.5 to 5.5); as did Enterprise (3.7 to 6.9), Avis (1.0 to 3.5), National (0.3 to 2.6), United Airlines (9.4 to 11.2), and Budget Car Rental (1.2 to 2.9).

However, in measuring overall consumer perception, none of the 17 partner brands tracked has moved in a statistically significant way—which, YouGov states, may indicate that American consumers are applying equal positive and negative pressure, depending on their politics and position on gun control.

One brand did turn up high on two key metrics: United Airlines. The airline made the biggest gains in both buzz and general brand impression.
